• Account & Profile: Name, email, phone number, and password.
• Business Data: For professionals, we collect business names, addresses, licenses, and pricing.
• Transactions: While we use Stripe for payments (so we don't store your full credit card number), we collect billing addresses and transaction history.
• Communications: Content of messages sent through our Platform and SMS opt-in records.

1.2 Information Collected Automatically

• Usage Data: IP addresses, browser types, and device identifiers.
• Cookies: We use essential, functional, and analytical cookies. You can manage these via your browser, but some features may break if disabled.

1.3 SMS and Mobile Data

If you opt-in to receive SMS notifications, we collect your mobile number and “consent metadata” (the timestamp and IP address of when you clicked ‘agree’).

We process your information under the following legal bases:

• Contractual Necessity: To book your appointments and process payments.
• Consent: For SMS marketing and non-essential cookies.
• Legitimate Interests: To prevent fraud, improve our UI/UX, and ensure Platform security.
• Legal Compliance: To meet tax, regulatory, or law enforcement requirements.

By providing your mobile phone number, you consent to receive SMS/text messages from The Local Gem regarding your account, bookings, transactions and appointments. Message frequency may vary. Standard message and data rates may apply.

You may opt out of SMS communications at any time by replying “STOP” to any message you receive, or by contacting us directly at support@thelocalgem.com. You may also reply “HELP” for assistance.

We do not sell, rent, or share your mobile phone number with third parties for marketing or promotional purposes. Mobile numbers and SMS consent data are retained only as long as necessary to provide the Service and demonstrate compliance with carrier and legal requirements.

We do not sell your personal information to third parties.

4.1 Third-Party Service Providers

We share data with providers who perform services on our behalf:

• Infrastructure: MongoDB Atlas (Data), Vercel (Hosting), Cloudinary (Images).
• Communication: Twilio (SMS), Brevo (Email).
• Payments: Stripe.

4.2 SMS Opt-In Data Exclusion

Depending on your residency (e.g., California or the EEA/UK), you have the following rights:

• Right to Know/Access: See what data we have collected about you.
• Right to Delete: Request that we erase your personal data.
• Right to Correct: Fix inaccurate info.
• Right to Opt-Out of Sharing: Request that we do not “share” your data for cross-context behavioral advertising (we currently do not do this).

The Platform is not directed to individuals under 13 (or 16 in the EEA). We do not knowingly collect data from children. If we learn we have, we will purge the data immediately.
